The learned counsel for the appellants/claimant Mr. N. B. Shaikh h/f Mr. V. S. Bedre along with representative of appellant Mr. Dinesh Bankar, Authorized Signatory for New India Assurance Co. Ltd and respondent No.1/original claimant along with his learned Advocate Mr. Aniruddha Usmanpurkar are present today. 3.

The parties have arrived at compromise. The terms of compromise are placed on record, they are duly signed by the parties and their learned Advocates. It is taken on record and marked as Exhibit 'X' for identification.

FA 922-2022 -24.

The report of the learned Registrar (Judicial) indicates that the terms of the compromise and parties are duly verified before him. The claimants herein permit to insurance company to receive a sum of Rs. 3,50,000/- (Rs. Three lakh fifty thousand only) from the amount deposited in this Court. In the facts of the case, the compromise is reasonable, hence accepted.

The insurance company is permitted to withdraw Rs. 3,50,000/- ( Rs. Three lakh fifty thousand only). Rest of the amount deposited in this Court along with accrued interest thereon be paid to the respondent No.1/claimant without reference to the Court. 6.

The award be drawn up accordingly. The request of refund of Court Fees shall be processed by the office in accordance with law. 7.

The first appeal stands disposed of in terms of the compromise Exhibit 'X'.
