The petitioners have put forth prayer Clause 'C' as under :- (C) Be pleased to issue appropriate writ, orders or directions in the like nature and respondent no.2 may kindly be directed to implement Order dated 26/11/2018 in R.D. No.11/2014 passed by Ld. Civil Judge Junior Division, Soygaon, Dist. Aurangabad, by carrying out the partition of suit property, which is at Exhibit 'C' 2.

It is contended that a decree was delivered in the original proceeding in Regular Civil Suit No.54 of 2002, on 23/12/2002. There is no appeal pending as per the petitioners. The District Collector has to initiate steps under Section 54 of the Code of Civil Procedure.

In view of the above, this petition is disposed off, with a direction to the District Collector to follow the due procedure in executing the decree.
