Heard learned Advocate for the parties for some time. 2.

The Applicant has filed this Anticipatory Bail Application as he apprehends arrest. The FIR is registered on 25 January 2025 in C.R. No.0061 of 2025 under Sections 118(2) and 352 of Bharatiya Nyaya Sanhita, 2023 ("BNS") with Georai Police Station, District Beed. 3.

At the very outset, Mr. Salunke, learned Advocate for the Applicant and Mr. Wani, learned APP for Respondents-State has drawn the Court's attention to the order dated 19 March 2025, whereby, the Applicant was protected subject to certain terms and conditions which was set out in the said order. Details of the complaint, FIR, offences

2 of 3 920-ABA.436.2025 alleged incident are noted in the said order dated 19 March 2025. Mr. Wani, learned APP would emphatically submits that the alleged incident which took place on 24 January 2025 at about 2.00 p.m. In the result, it is attributable to an alleged assault between the persons named in the FIR. The case diary which also contains the injury certificate dated 24 January 2025 would reveal that the Applicant has been inflicted injury on his forarm elbow joint, which is stated to be grievous in nature. This is the only injury which is shown as far as the present incident is concerned. It also appears from the record that present Applicant has also been assaulted by the informant. However, the nature of injuries at this stage are not known. Mr.

Wani would also submit that the alleged weapon/axe are recovered and no further recovery needs to be effected. The prosecution would not dispute that the Applicant has cooperated with the investigation. He has also attended the police station as directed by the order dated 19 March 2025 as directed. This would indicate that the Applicant has joined the investigation. As far as prima-facie case is concerned, there is nothing additional which is brought on record pursuant to the order dated 19 March 2025. The Applicant does not have any criminal antecedents. 4.

In the above circumstances, it would be just and proper to confirm the interim order dated 19 March 2025 by passing the following order, which in my view would be ends of justice:-

O R D E R

(i) In the event of arrest of the applicant in connection with C.R. No.0061 of 2025 registered with Georai Police Station, District Beed, for the offences punishable under Sections 118(2) and 352 of Bharatiya Nyaya Sanhita, 2023, the applicant is directed to be released on bail on their furnishing PR bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand Only) with one or more sureties in the like amount.

(ii) The Applicant shall cooperate with the investigation and shall attend the concerned police station as and when required/called for, until filing of the charge-sheet. (iii) The Applicant shall furnish details of residential address and other contact details such as mobile number etc. to the concerned police station. If there is any change in the contact details, the same shall be immediately intimated to the concerned police station.

(iv) The Applicant shall not leave the jurisdiction of the Court without prior permission/order of the Court, until further orders.

(v) The Applicant shall not influence the witness/es and/or tamper evidence in any manner whatsoever.

Needless to mention that the observations are prima-facie for the purpose of adjudication of this anticipatory bail application. 4.
