The learned counsel submits that the applicant-original plaintiff instituted the suit for a decree of specific performance of contract in which the trial court has passed the order of "no evidence" against the applicant/plaintiff. The learned counsel, on instructions, submits that the said suit is still pending and it is yet to be disposed of by the trial court.

In view of the above and for the reasons stated in the Civil Application, the Civil Application is allowed in terms of prayer clauses (B) and (C) subject to costs of Rs.2,000/- to be paid to
