Heard the learned counsel for the applicanta and the learned A.P.P. for the respondents/State 2.

The applicants were driver and cleaner of the truck in which the chemical liked to be used to prepare duplicate liquor was seized. The articles with cash lying in the truck were seized by the police. They have undergone the police custody. Admittedly, they were not owners of the goods carried in the truck. They have also disclosed the name of the owner as per their knowledge. Nothing is to be investigated from them. In the circumstances they may be released on bail on certain conditions. Hence, the following order :-

ORDER

(i) The application is allowed.

(ii) Applicant Nos. (1) Kiran Madhukar Thorkar and (2) Pravin Lotan Gavande be released on bail on furnishing P. B. and S.B. of Rs. 50,000/- (Rupees Fifty Thousand only) each with one solvent surety of the like amount each, in Crime No. 72 of 2023 registered with Phulambri Police Station District Aurangabad for the ofences punishable under Section 328 of the Indian Penal Code and under Sections 65(a), 65(f) of The Maharashtra Prohibition Act, on the condition that : they shall attend the police station on frst and third Friday of each month, between 11 a.m. to 12.00 p.m, as and when investigating ofcer call them on written notice till fling the charge sheet.
