VERSUS

THE DEPUTY CHARITY COMMISSIONER, JALGAON AND ANOTHER Advocate for Petitioner : Mrs. S.P. Mahajan.

AGP for Respondent No. 1 : Shri S.P. Deshmukh. Advocate for Respondent No. 2 : Shri P.R. Katneshwarkar. CORAM : RAVINDRA V. GHUGE, J.

Dated : 04th July, 2017 PER COURT :

1.

Shri Katneshwarkar, learned advocate for the contesting respondent No. 2, in these matters, submits on instructions from Mahendra Vasantrao Deshmukh, R/o. At post. Adavar, Tq.

Chopda, Dist. Jalgaon, present in the Court, that the petitioner has passed away on 30/06/2017. A copy of the newspaper Daily Divya Marathi, Jalgaon edition is placed on record to support the instruction as the news of the demise of the petitioner has been published in the said newspaper. 2.

There is no dispute that in such matters, the passing away of the trustee or the elected office bearer would not lead to LR.s. being brought on record for contesting the change report proceeding. The newspaper cutting placed on record is marked as 'X' for identification.

3.

Considering the statement recorded as above and exhibit 'X', this petition is disposed of as being infructuous. ( RAVINDRA V. GHUGE, J. ) S.P.C.
