The petitioners who are serving as teachers with the respondent/management which is the same are awaiting approval to their transfers effected by the management in the light of Rule 41-A of the Maharashtra Employees of the Private Schools (Conditions of Service) Rules, 1981.

The writ petitions are disposed of directing the respondent no.5Education Officer (Secondary) to consider these proposals on their own merits and without referring to government resolution dated 29.04.2024 and circular dated 03.10.2024 which have been held to be illegal in the matter of Mansi Arun Kelkar V/s. State of Maharashtra & Ors. (writ petition no.1021/2025) decided at this bench on 03.02.2025. The decision shall be taken as expeditiously as possible and in any case within six weeks. [Y.G.
