2] Heard learned APP for applicant and the learned counsel for respondents. Perused the record and proceedings of the trial Court. 3] On due consideration of submissions advanced, in the light of the oral and documentary evidence on record, particularly the testimony of (PW4), I am of the view that case is made out to grant leave to file appeal. Hence following order :

-2ORDER [I] Leave granted. Application is allowed in terms of prayer clause "B".

[II] Appeal be registered. On admission of appeal, Shri Bagul, learned counsel waives notice for respondents. [III] Call for Record and Proceeding.
