The learned A.P.P. submits that there is delay of 43 days to file an application seeking leave to present appeal against the impugned judgment and order of acquittal of the respondentaccused. The learned A.P.P. further submits that the delay was caused due to compliance of official procedural and it was not intentional or deliberate one, but, caused due to official procedure. He prayed to condone the delay.

The learned counsel for respondents raised objection and submits that there was no reasonable cause for condonation of delay. He prayed to reject the application.

For the reasons mentioned in the application, I do not find any impediment to condone the delay. In such circumstances, the application is allowed in terms of prayer clause 'B' and stands disposed of accordingly. Delay is condoned. Registry to take requisite steps for further process.

After due compliance, list the application for seeking leave for hearing on 31st July, 2017.
