Learned Advocate for respondent no. 3 is tendering the certified copy of the charge framed against the applicants by the learned trial Court on 28.07.2023 and also submitted that the trial is part heard. 2.

He also tenders certified copy of the evidence of PW - 1 / Ashok Sirsat i.e. present respondent no. 3. Even cross-examination has been started on behalf of the applicants.

In view of this position, after the disinclination is shown to grant relief in view of the fact that the matter is part heard, learned Advocate for the applicants, seeks withdrawal of the application, upon instructions. 4.
