By this application, the applicant seeks to condone the delay of 525 days caused in filing the appeal. The notice of this application is served upon respondent no.1.

The learned Advocate appearing for respondent no.1 submits that he will be filing Vakalatnama within a period of one week. He opposes the prayer to condone the delay .

Mr. Bhalerao, learned Advocate appearing for the applicant submits that the delay is occurred on account of the procedural aspects as mentioned in Paragraph No.2 of the application. 1/2

Considering the reasons as stated in the application, the sufficient cause is made out to condone the delay. Hence, this Court proceeds to pass the following order:

ORDER

(i) Application is allowed in terms of prayer clause ' A'

and the same is disposed of accordingly.

(ii) Appeal be registered.
