This application is filed under section 439 (2) of the Criminal Procedure Code, seeking cancellation of anticipatory bail granted to the respondents - accused, by the Sessions Court, vide order dated 10th February, 2021, thereby releasing them on anticipatory bail in Crime No. 40 of 2021 registered with Kranti Chowk Police Station, Aurangabad for offence punishable under sections 465, 468, 420, 406, read with 34 of the Indian Penal Code.

Heard learned advocate for the applicant, learned Additional Public Prosecutor and learned advocate for respondent

During the course of hearing of this application, it is revealed that charge sheet, in the present matter is filed on 24th March, 2022 and the case is numbered as RCC No. 535 of 2022. The matter is kept for framing of charge on 2nd February, 2023. 4.

In the light of these developments, it is not desirable to cancel the anticipatory bail granted to the respondent - accused by the Sessions Court, almost two years after the same is granted.

The application is, therefore, dismissed.
