The learned Counsel for the petitioner submits that an application under Section 28A has been filed by the petitioner in the year 2010 with respondent No.6. It has been transferred to respondent No.5. The same is not yet decided.

In case the application is filed by the petitioner and the same is pending with respondent No.5 and if respondent No.5 is competent to decide it, the respondent No.5 shall take decision on its own merit
