This application is filed by the wife seeking transfer of matrimonial proceeding bearing Petition No. A-69 of 2023, from the Court of learned Judge, Family Court, Belapur to the Court of learned Judge, Family Court at Jalgaon.

The proceeding is filed by the respondent-husband for restitution of conjugal rights on the ground that the applicant-wife is residing at Jalgaon. The wife has already initiated two proceedings i.e. PWDVA No. Ethape

( 2 ) 955 MCA-98-2024 257 of 2023 under the Domestic Violence Act at Jalgaon and another proceeding is filed bearing Petition E No. 117 of 2023 seeking maintenance from the husband. These petitions are filed and pending in the Court of learned Judge, Family Court at Jalgaon. 4.

During the course of argument, the learned Advocate for the respondent has placed on record a copy of order dated 15th September 2025 passed by this court at principal seat at Mumbai in MCA No. 407 of 2024. By way of said order, this Court has already transferred the proceeding from Jalgaon to the Court at Belapur. The order appears to be passed by consent of both the learned Advocates appearing at Mumbai.

This Court, therefore, does not find any propriety in entertaining the present application, as already both the parties have given consent to transfer the proceeding pending at Jalgaon to the Court at Belapur. 6.

With this, Misc. Civil Application stands dismissed with no order as to costs.
