DATE : SEPTEMBER 12, 2022 ORDER :- This is an application under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.0045 of 2014 registered with Basamba Police Station, Dist.Hingoli.

Heard learned counsel appearing for the parties. 3.

The applicant has been behind the bars for little over 7 years and 10 months. The amount involved in the present crime is about Rs.65 Lakhs. Charge has not yet been framed. True, the applicant has been behind the bars in connection with another crime as well. It is informed that he has been granted bail in other crimes.

Present application deserves to be allowed on the ground of long incarceration and he came forward to deposit Rs.5 Lakhs. 5.

Hence, the following order:- (i) The application is allowed.

(ii) On the condition of the applicant's depositing Rs.5,00,000/- (Rupees Five Lakhs) with the trial Court, the applicant be released in connection with Crime No.0045 of 2014 registered with Basamba Police Station, Dist.Hingoli, on executing P.R. Bond in the sum of Rs.50,000/- (Rupees Fifty Thousand) with one surety in the like amount.

(iii) The direction to deposit the amount is a condition precedent for grant of bail to the applicant. (iv) The applicant shall not tamper with the prosecution evidence.
