Instant application is for temporary bail on account of arrest of applicant in Crime No. 0120 of 2025 registered at M.I.D.C. Waluj Police Station, Ch. Sambhajinagar (City) for offence under Sections 109(1), 137(2), 351 (3), 3(5) of the Bharatiya Nyaya Sanhita, 2023 (BNS).

Learned counsel submitted that applicant is a student of BBA Course and he is in 6th Semester. He came to be arrested in above crime on 02.03.2025 and is in MCR since 04.03.2025. That, being a student, as per guidelines of the course and its requirements, he is expected to submit Dissertation Report for this semester. That, institution has directed submission of report by 27.03.2025. That, it is essential for his education and he thereby intends to submit the Dissertation Report and to enable him to do so, learned counsel seeks temporary bail up to 28.03.2025.

Learned APP has no objection, more particularly in the academic interest of the applicant, he being a student, however learned APP seeks appropriate conditions to achieve purpose of both sides.

Taking the above submissions into consideration, the guidelines issued by MGM University at Exhibit "A" and the statement made across the bar by learned APP that, on request of applicant's parents, the above institution has permitted applicant to tender dissertation/project report by 27.03.2025, purely in the academic interests of the applicant, instant application for his temporary release deserves to be allowed. Hence, following order :

-3ORDER I.

The application for temporary bail is allowed. II.

Applicant be released on temporary bail for a period from 21.03.2025 to 28.03.2025 in connection with Crime No. 0120 of 2025 registered at M.I.D.C. Waluj Police Station, Ch. Sambhajinagar (City), on executing Personal Bond of Rs. 15,000/- with one surety in the like amount, on the following conditions :

[a] During the period of his release on temporary bail as above, the applicant shall report M.I.D.C. Waluj Police Station, Ch. Sambhajinagar daily in the evening between 7.00 p.m. to 8.00 p.m and shall maintain diary of his such visits.

[b] The applicant shall not leave vicinity of Ch. Sambhajinagar (Aurangabad) City under any conditions without prior permission of this Court.

[c] The applicant shall surrender before the prison authorities by 04.00 p.m. of 28.03.2025.
