For the reasons stated in the application, the same is allowed in terms of prayer clause "B". The delay caused in filing the present application stands condoned. The impugned order of dismissal of the appeal No. 478 of 2010 dated 05-01-2011 is hereby set aside. The Registry to take requisite steps for further process and list the matter for final hearing at the stage of admission on 27-11-2017. 3.
