PER COURT:

Perused the application. After restoration of appeal, it is necessary to secure the presence of the respondent No.2 who is the owner of offending vehicle. Hence, civil application stands allowed in terms of prayer clause (B). Issue notice to respondent No.2 through paper publication returnable on 15th January, 2018. Civil application stands disposed of accordingly.

Registry to do the needful to facilitate the appellant for publication of notice to be served on respondent No.2 in daily newspaper as prayed. Learned counsel for the respondent/original claimant submits that he has not received the copies of appeal memo and other relevant documents. Mr. Soman, learned counsel for appellant undertakes to supply the same within two weeks.
