Mr. Deshmukh, the learned counsel for the petitioner submits that, the petitioner had moved an application/representation with the respondent No. 2/Collector seeking refund of the amount of deposit, as the petitioner could not excavate the sand. No decision is taken on it as yet. 2.

We have also heard Mr. Patil, the learned Additional Government Pleader for respondents.

In case the representation (Exhibit F page 48) is pending with the respondent No. 2, then the respondent No. 2 shall take
