Heard learned Advocates for the parties. This application is filed for condonation of delay of 117 days caused in filing appeal challenging an order granting anticipatory bail to the respondent. It is argued that the appellant is a person belonging to the Scheduled Caste. He is not having sufficient knowledge of court proceedings. Also due to paucity of funds he could not approach the Court earlier. 02.

This application is opposed by learned Advocate Mr. Savant. He submits that the challenge is sought to be raised on merit and not on any other ground such as breach of condition etc. The applicant has knowledge of passing of the order. No sufficient ground is made out. He prays for rejection of the application.

Considering that the appeal is by a victim in a case under the provisions of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act and for the reasons stated in the application, this Court is inclined to allow the application.
