Versus
The State of Maharashtra & others Respondents Mr.S.R.Choukidar, Advocate for the petitioner. Mr.M.M.Nerlikar, Assistant Government Pleader for Respondent No.1.
Mrs.Y.M.Kshirsagar, Advocate for Respondent No.2. Mr.V.J.Dhage, Advocate for Respondent No.4.
CORAM : NARESH H. PATIL, C.J. & N.M. JAMDAR, J.
DATE : 13th December, 2018 PER COURT:
Perused the order passed by this Court on 26.02.2010 in Writ Petition No.2385 of 2007 with connected writ petition; and the order passed by the Education Officer (Primary). The dispute, at the relevant time, was in respect of the seniority and the appointment of petitioner and the Respondent No.4 as to who should hold the post of the Head Master. Learned Counsel for the respective parties state that the Respondent No.3 is a Minority Education Society. None appears for Respondent-Management.
{2} wp409917.odt Another vital development in the matter is that Respondent No.4, admittedly, has retired on 31.08.2017 and petitioner has been working as Head Master under the interim order passed by this Court.
In respect of change of date of birth, Respondent No.4 has resorted to certain proceedings about which we do not express any opinion.
In view of subsequent development, leaving the issue to the Management to take the appropriate decision, writ petition is disposed of.
In view of disposal of writ petition, pending Civil Application does not survive and stands disposed of. N.M.JAMDAR, J. CHIEF JUSTICE adb/
