ORDER :

Both the appeals are filed by original claimants to challenge the orders made under section 140 of Motor Vehicle Act. The applications filed under section 140 are rejected by the Tribunal. The orders were made in the year 2009. Though appeal is tenable against the said decision as it is treated as award, the matters are very old and this point can be considered by the Tribunal while deciding the matters filed u/s. 166 of the Act. 2.

In view of these circumstances, this Court holds that due to expiry of so many years, nothing survive in the appeals, this point can be considered by the Tribunal while considering the entitlement of the claimants u/s. 166 of the Act.
