Mr.Thigale, learned counsel submits that he would restrict present petition to the extent that the petitioner would approach respondent no.2 with regard to the intake capacity and the respondent no.2 to take decision upon it.

2] We have heard Mr.Tekale, advocate for respondent no.2. 3] With regard to the prayer against State Government, petitioner may agitate with the State Government and if no action is taken, the petitioner may approach the Court. All contentions of the parties are kept open.

4] The petitioner may make application/representation to the respondent o.2 with regard to the reduction in its intake capacity. The respondent no.2 shall take decision upon it on its own merits in accordance with law expeditiously preferably within 8 weeks.
