Heard the learned counsel for the applicant and the learned APP for the respondent-State.

The investigating officer did not segregate the flower tops from the cannabis plants. That apart, the total weight of the cannabis trees with steam, leave, etc. was 14.318 Kg. It is below commercial quantity. Muddemal was recovered from the accused. There are no antecedents to the discredit of the applicant. The investigation has been completed as soon as raid was successful. However, detention of the applicant would serve no purpose. Hence, the following order :

(i) Bail Application is allowed.

(ii) Applicant Rambhau Suryabhan Gorde be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.48 of 2023, registered by Police Station Pachod, District Aurangabad, for the offence punishable under Section 18 of Narcotic Drugs and Psychotropic Substances Act, 1985, on the following conditions :

(a) The applicant shall not tamper with the prosecution witnesses.

(b) He shall attend the police station as and when called by the Investigating Officer on written notice.

(c) He shall not involve in the similar crime.
