The petitioner challenges election result declared on IndexE-17 by respondent No.4. 2.

It is the contention of the petitioner that recounting of votes was claimed and while doing so, the prescribed procedure was not followed.

The petitioner has alternate efficacious remedy of filing election dispute.

Since disputed questions of facts are involved in the present matter and in view of availability of alternate efficacious

{2} wp3795-22 remedy, this Court is not inclined to entertain the writ petition. 5.

In the light of the above, the writ petition is dismissed with liberty to the petitioner to avail alternate remedy. All the contentions of the petitioner are kept open.
