The applicant/appellant has moved this application seeking condonation of 55 days delay in filing the appeal for the reasons set out in the application.

In brief, it is the contention of learned counsel for applicants that the delay caused in filing the appeal was not deliberate but due to secure the sanction from the higher authorities for filing the appeal.

On the other hand, learned counsel for respondents opposed the application with contention that the cause assigned in the application cannot be treated as a sufficient cause to condone the delay and urged to reject the application.

Considering the submissions advanced in the light of unchallenged pleadings made in the application, I am of the view, the case is made out to condone the delay. Accordingly, the application is allowed in terms of prayer clause 'B'. 6.

Delay condoned. The appeal be registered and placed for admission on 23.04.2019.
