Criminal Application No.915/2021 moved to assist APP is allowed and disposed of.

In view of the recent medical report of the applicant, on instructions, learned Advocate for the applicant, prays for withdrawal of the application. He submits that liberty be granted to him to approach the Trial Court for bail though his earlier bail applications have been rejected.

As regards the present bail application is concerned, he was seeking temporary bail on medical ground. However, now the recent medical report shows that he does not sufer from illness. Under such circumstance, there is no hurdle in allowing the applicant to withdraw the bail application and it is accordingly permitted to do so. As regards the liberty is concerned, if any right exists, he may exercise it.
