This application is for transfer of proceedings being Criminal M.A. no. 69/2017 pending on the fle of Judicial Magistrate First Class, Yawatmal, to Judicial Magistrate First Class Jintur or Parbhani.

There is no dispute about the fact that respondent No. 2 has fled application before the competent Court. There is also no denial of the fact that respondent No. 2 is staying with her minor child at Yawatmal. As far as grievance of applicants No. 1 and 2 is concerned, they claim to be of old age with comorbidities. Learned counsel for respondents makes a statement on instructions that he

- 2 - criappln867.20.odt has no objection if applicants No. 1 and 2 are permanently exempted from appearance in the said Court. This is treated as undertaking and accepted.

Once applicants No. 1 and 2 are not required to attend the Court, their grievance stands redressed. In such circumstances, there is no need to transfer the proceedings from Yawatmal to any other place.
