1] This is an application for condonation of delay in filing the appeal under Section 54 of the Land Acquisition Act by the original claimants. In order to show his bonafides, learned counsel for the appellant/applicant submitted that the applicant would file an undertaking before this court within a period of 4 weeks from today to the effect that they will not claim any statutory benefits for the period of delay in the event of allowing the appeal. Apart from such bonafide conduct, the delay in filing the appeal is sufficiently explained. Same is not controverted by filing counter. As such, though learned AGP opposed the application by contending that the delay is not sufficiently explained, the application deserves to be allowed. Same is allowed. Delay in filing appeal is condoned. Application stands disposed of.
