3) We have heard the learned counsels for the parties and have perused the averments made in the Civil Application. The applicant has sufficiently explained the delay of 624 days caused in filing the First Appeal, in the Civil Application. For the reasons recorded in the Civil Application, delay of 624 days in filing of the First Appeal is condoned.
4) Civil Application is made absolute in terms of prayer clause (B).
