I have heard the learned Advocates for the petitioner, respondent Nos. 7 to 10 and the learned Government Pleader, on behalf of respondent Nos.1 to 6.

Shri Girase, learned GP submits that the petitioner's plot admeasuring 109.44 sq. meters in CTS No.3193 has already been regularized by the order dated 29.11.2004 and he is not in the arena of the enquiry as is directed by the Honourable Minister while the impugned order dated 13.11.2006.

Shri Bachate, learned Advocate for the petitioner submits that he has preferred this petition under a serious apprehension and fear that he may lose his plot. He was unable to distinguish as to whether his plot is within the arena of the enquiry and hence this petition has been filed. He prays that costs may not be imposed as the petitioner is willing to withdraw the petition, in view of the statements made above. 4.
