1) Mr. Talekar the learned counsel for the petitioner submits that, the petitioner has applied with the Government seeking extension of time to excavate the sand. The respondents are proceeding with the tendor for allotment of the said sand spot. However, the Government is not deciding the application of the petitioner, though, the same is pending since 31 st January, 2015.

2 WP3470.15 2) Mr. Sangle the learned A. G. P. states that, respondent No. 1 would decide the said application of the petitioner on its own merits in accordance with law within four

(4) weeks.

3) In light of the above, the writ petition is disposed of. The respondent No. 1 shall decide the application of the petitioner seeking extension of time for excavation of sand on its own merits in accordance with law, policy expeditiously and preferably within four (4) weeks. Writ petition disposed of. No costs.
