This matter is taken up through Video-Conferencing during the nationwide lock down on account of Covid-19 pandemic. 2.

This matter was heard for a considerable time in the first session. 3.

During the hearing of the matter, the learned Advocate for the petitioner noticed that the State Government follows a reservation policy as a part of the requisite admissions rules while filling in the seats of all India quota pertaining to NEET P.G. Medical - 2020, upon conversion into a State quota to the extent of seats that have gone vacant. The learned counsel for the petitioner, therefore, sought a pass over to take instructions.

After the Lunch recess, when the matter was called out, the learned Advocate for the petitioner submits that as the State Government had applied the reservation policy in 2018 to such converted All India Quota seats while filling them upon conversion as State Quota seats, the petitioner desires to challenge the applicability of the reservation policy even to such seats and for the said purpose, the petitioner desires to challenge the Government Resolution dated 2.1.2018.

The petitioner, therefore, seeks leave to withdraw this petition so as to file a proper petition for challenging the legality and validity of the Government Resolution dated 2.1.2018 issued by the Medical Education and Drugs Department.

In view of the above, this petition is disposed off as withdrawn with liberty as prayed for.

It is made clear that this Court has not expressed any opinion as regards the merits of the challenge to the aforesaid Government Resolution, dated 2.1.2018.
