Heard the learned counsel for the applicants, learned APP for the respondent-State and the learned counsel for respondent No.2/victim.

Applicant No.1 is the step father and applicant No.2 is his friend. Serious allegations have been levelled against them that they were molesting the victim girl.

Learned counsel for the applicants submits that the evidence of the victim has been recorded. However, she did not support. On perusal her deposition, it appears that on 04.01.2023, she appeared before the Court. But, before completing her evidence, she started crying. Therefore, the

923-BA.495-23.odt Court adjourned recording her statement. On 21.01.2023, she appeared but did state nothing. However, aunt and another sister of the victim categorically deposed against the accused. The mother of the victim is also not with her. She is also the co-accused. From the facts, the safety of victim is to be considered in this case. Two male persons were molesting her and doing indecent acts with a girl of 16 years old. Considering the facts and circumstances of the case, the Court is not inclined to grant them bail. Hence, the following order :

O R D E R

(i) Bail Application stands dismissed.

(ii) The Trial Court is directed to expedite the trial and dispose of the case at the earliest subject to cooperation of the accused and prosecution. (iii) Learned Trial Court shall conduct the trial day-today. (S. G. MEHARE, J.) ...
