Petitioners have challenged the issuance of process against them in Regular Criminal Case No. 62/2016 by learned Judicial Magistrate First Class, Rahuri, Dist. Ahmednagar. 2.

Learned advocate for petitioners submits that original complainant/respondent No. 2 is expired five to six months back. 3.

Petitioners are therefore entitled to bring this fact to the notice of Trial Court by filing application under section 256 Cr.P.C.

Writ petition is therefore disposed of with liberty to petitioners to approach Trial Court by filing application under section 256 Cr.P.C.
