Mr. Thoke, the learned counsel for the petitioner submits that, though N. A. permission is granted to the petitioner, however, clause 4 of the said permission dated 14.03.2016 is ambiguous and states that, if the Government decides that payment of Najrana is essential, then the petitioner will have to pay the same and such an entry is taken in the 7/12 extract. The same is illegal.

Mr. Virdhe, the learned Assistant Government Pleader on instructions received to him from the Revenue and Forest Department, Mantralaya, Mumbai, states that, the State has confirmed that, Najrana is not required to be paid with respect to

2 wp 3692.15 the writ land of the petitioner. The learned A. G. P. has placed on record the said communication. The same is taken on record and marked "X" for identification.

In the light of the above, by the letter dated 26th October, 2016, it is clear that, the petitioner is not required to pay the Najrana in respect of the writ land.

With these observations, writ petition is disposed of. No costs.
