The sole respondent Abdul Karim Abdul Razzak reported dead vide Bailiff report dated 17.8.2017. Thereafter, this fact was notified vide notice dated 1.3.2021 as contemplated under Chapter VII Rule (6) of the Bombay High Court Appellate Side Rules,1960, however, no steps are taken to bring on record legal heirs. In turn, the appeal stands abated against sole respondent and consequently, entire appeal is disposed of accordingly by virtue of provisions under Chapter VII Rule 6 sub-clause (2) of the Bombay High Court Appellate Side Rules, 1960.
