Mr. Bondar, the learned Counsel for the petitioner submits that in the present matter, the petitioner would not agitate his challenge to the notification.

In view of the said statement, nothing remains for adjudication in the present Writ Petition.

The learned Counsel submits that for the past three years, the petitioner has paid excess renewal fees. The same is required to be adjusted.

It is submitted that average sale of preceding three years is to be considered for calculating the licence fee for current year. 5.

The respondent shall consider the same and if excess fee is deposited, the same be considered for adjustment in the current years renewal fees.

With these observations, the Writ Petition stands disposed of. No costs.
