The petitioner has challenged the order dated 25.01.2023 passed by the learned Additional Divisional Commissioner, Aurangabad i.e. respondent No.1, rejecting the application filed by the petitioner seeking stay to the order of termination dated 14.11.2022. The application was filed in Appeal No.75 of 2022. The petitioner submits that the order of termination is passed without following the principles of natural justice and is nullity in the eyes of law. For this reason the order ought to have been stayed by the Additional Commissioner.

Considering that respondent No.1 is seized of the matter since November, 2022 and since the appeal is in respect of termination of the petitioner, this Court finds that interest of justice would be met by directing respondent No.1 to decide the appeal filed by the petitioner i.e. Appeal No.75 of 2022, pending before him within three months from today. 03.
