The learned Counsel respondent/non-applicant submits that the non-applicant has prayed for withdrawal of the proceedings of which transfer is sought by way of present Miscellaneous Civil Application, however, in view of operation of interim relief, the said prayer for withdrawal was rejected.

In view of above submissions, the present application for transfer of proceedings stands rejected. Needless to say that the interim relief granted by this Court also stood vacated. 3.

The above order is passed based upon statement made by nonapplicant/respondent that he shall be withdrawing proceedings bearing H.M.P. No.53/2014 pending on the file Civil Judge, Senior Division, Latur.
