By this Application, the Applicant seeks suspension of substantive sentence imposed upon him by the learned Additional Sessions Judge-1, Nanded, vide the Judgment and Order dated 05.12.2023 passed in Sessions Case No. 11/2021. 2.

Heard learned advocate for the Applicant and the learned APP for respondent/State.

It is brought to our notice that the co-convicts/co-appellants have been granted bail and their sentence has been suspended by this Court vide order dated 22nd January, 2024. It is not in dispute that the

2 17APPLN1226.2024&Ors.odt applicant/appellant herein is similarly situated with the said co-convicts/co-appellants, who have been granted bail. 4.

In view of the above, Criminal Application No. 1226 of 2024 is allowed in terms of the order dated 22nd January, 2024 passed in Criminal Application No. 382 of 2024 in Criminal Appeal No. 80 of 2024 and connected two applications.

Application is, accordingly, disposed of.
