This application is on behalf of the applicants, signed by their counsel and even sworn by their counsel, stating therein that in view of stay granted by this Court in the Second Appeal by order dated 12.01.2016, the impugned orders in the Second Appeal should be stayed. The learned counsel

( 2 ) 44 CA 6970 OF 2025 for the respondents specifically raised objection to this contention and stated that no stay order was passed in this Second Appeal on 12.01.2016. The statement made in the paragraph No.3 of this application is totally false. He submits that the order dated 12.01.2016 is only for calling the record and proceedings and there is no specific order of stay to the execution of the impugned order.

On having been confronted with this position, the learned counsel for the applicants seeks permission to withdraw the Civil Application and tenders apology.
