Learned Counsel for non-applicant-husband makes statement that he intend to withdraw the proceedings bearing No. P-261/2013 initiated under Section 9 of the Hindu Marriage Act, 1955 for restitution of conjugal rights, which is pending on the file of Family Court, Aurangabad, of which transfer is sought by present applicant to Civil Court, Senior Division, Ambajogai.

In view of above statement, Misc. Civil Application has rendered infructuous. Misc. Civil Application, as such, stands disposed of as infuctuous.
