ORAL JUDGMENT :

None present for the petitioners and respondent Nos. 3 and 4.

This Court ( Coram : A. P. Deshpande - J.) has passed a detailed order dated 29/11/2003 admitting this petition. 3.

The petitioners were aggrieved by the order dated 13/09/2003 passed by respondent No. 4 and had prayed for permission to operate the Ayurved College for the academic year 2003-2004. By the order dated 29/11/2003, the petitioner, who had sought permission to admit 40 students, was granted interim relief to the extent of admitting 30 students only.

As such, this petition is partly allowed in terms of the interim order dated 29/11/2003. Rule is made partly absolute.

It is, however, made clear that in the event the petitioner college is not functional pursuant to the passing of the order dated 29/11/2003 or any time thereafter, this order passed today shall not amount to restoring the permission to the petitioner to admit 30 students and start operating the college.
