1] Heard learned counsel for the applicant and the learned APP for the respondent-State.
2] The applicant is apprehending arrest in connection with Crime No. 1105/2024, registered with Kotwali Police Station, Ahilyanagar, for the offence punishable under Section 352, 351 (2), 3 (5), 118 (2), 115
(2) of the Bharatiya Nyaya Sanhita, 2023.
3] The allegation against the applicant is that the applicant had assaulted the informant by using knife on his vital part.
450.25ABA 4] The learned APP points that due to assault, the grievous injury is caused to the informant on the vital part of the body.
5] Considering the grievous injuries caused to the informant with weapon i.e. knife, no case is made out for grant of anticipatory bail. Hence, the present application is dismissed.
6] It is also clarified that the observations made in this order are limited to the disposal of the present anticipatory bail application and the trial Court shall not be influenced by the observations of this Court while deciding regular bail or at trial.
