This petition challenges order of Maharashtra Administrative Tribunal, holding that respondent's suspension was not proper. The respondent was therefore reinstated. The Departmental Enquiry, however, remained pending since prior to 2003. This Court permitted petitioner-Employer to complete this enquiry within one year but, in vain. In 2009, the respondent reached the age of superannuation. In view of this, there is no reason why we should examine the correctness of the impugned order, which is only in respect of suspension of respondent. Petition stands disposed of as infructuous.
