For the reasons mentioned in the application, couple with the nature of the dispute and the fact that the sole respondent had died during pendency of the appeal, which was filed in the year 1999 and stood admitted by the order dated 5 August 1999, application is allowed. Delay is condoned. Abatement, if any, is set aside.
