A proposal for opening new Arts, Science and Commerce College at Chikalthana, Aurangabad was not considered by the respondent on the ground that respondent No.3 is issued with Letter of Intent. It is submitted that the proposal of respondent No.3 is cancelled and negatived. The Letter of Intent is also cancelled.

The last date for submission of the proposal for the academic year 2020-2021 to the State Government by the

(2) WP-4313.2019.odt University is 30 November 2019. The petitioner's proposal can now only be considered for the academic year 2020-2021 and on the ground that the location where petitioner wants to start the college, is available.

The State Government shall consider the proposal of the petitioner that is submitted before it for the year 20192020 to start Arts, Commerce and Science College at Chikalthana, Aurangabad for the year 2020-201, in view of the fact that the proposal for the year 2019-2020 was not considered on merits on the ground that respondent No.3 was issued Letter of Intent and now the Letter of Intent in favour of respondent No.3 also stands cancelled. The decision shall be taken within the time stipulated under Maharashtra Public Universities Act, in case the college at the said location is permissible for the year 2020-2021.
