Heard learned counsel appearing for the parties. 2.

Mr. Palodkar, learned counsel appearing for applicant refers to the reasons given under paragraph no. 3 of the application and submits that it is on that account that that delay has been caused, whereas Mr. Swapnil Patunkar learned counsel appearing for respondent submits that the delay is enormous and cannot be said to have been properly explained. However, he has not been in a position to counter veracity of contents of paragraph no. 3 of the civil application.

In the circumstances, I deem it appropriate that civil application deserves favourable consideration. 4.

In view of the same, delay stands condoned. Civil application is allowed and disposed of.
