1] Heard the learned counsel for the petitioner. The learned counsel for the petitioner submits that on 28.07.2023 the petitioner filed an application for amendment in the written statement. Thereafter, on 11.08.2023, the respondent filed his say. However, the 2nd Joint Civil Judge Senior Division, Latur rejected the said application by order dated 26.10.2023 below Exh.114 in Special Civil Suit No.44/2024. Being aggrieved by the said order, the present writ petition is filed.

4539.24WP 2] It appears that for the same cause earlier the petitioner had filed Writ Petition No.6974 of 2018, challenging the order passed by 3rd Joint Civil Judge Senior Division, Latur, below Exh.73 in Special Civil Suit No.44/2024 and by order dated 19th June, 2023, this Court has dismissed the said Writ Petition.

3] In view of the same, the present Writ Petition is dismissed.
